Overview

The NYCRC is committed to assisting each investor and their attorney throughout the EB-5 petition process.  In addition to answering questions throughout the process, we help each investor gather and prepare documentation in support of the necessary petitions.

The NYCRC can also suggest highly qualified immigration attorneys with experience preparing EB-5 petitions.  These attorneys, along with the NYCRC team, help coordinate an efficient process for the investor from project selection to obtaining a permanent green card.

There are three (3) primary stages when applying for a green card under the EB-5 Regional Center Program.

  • Stage 1: An investor submits an I-526 Petition.  For information regarding the I-526 Petition, click here to visit the USCIS website.
  • Stage 2: Once the investor’s I-526 Petition is approved, he or she will be given a U.S. Consular Interview or, if the investor currently resides in the U.S., receive an adjustment of status.
  • Stage 3: Lastly, two (2) years from the date that the investor is granted a conditional green card and enters the U.S., he or she must submit an I-829 Petition to remove the conditions on the green card. In the I-829 Petition, the investor must demonstrate that he or she has satisfied the requirements necessary to receive a permanent green card, such as showing that 10 jobs for U.S. workers were created from the investment.  For information regarding the I-829 Petition, click here to visit the USCIS website.
